Terms of Service

These Terms of Service ("Terms") govern your use of the SellMate AI Chrome extension and the website sellmate.store (together, the "Service"). By creating an account or using the Service you agree to these Terms.

1. Acceptance

By installing the extension, signing in with Google, or creating an account, you confirm that you are at least 16 years old and accept these Terms and our Privacy Policy.

2. The Service

SellMate AI provides AI-assisted tooling for online resellers, including:

• Photo analysis and automatic listing generation for Vinted, Etsy, and compatible marketplaces
• Bulk-edit, repost, cross-account, and related seller productivity tools
• Subscription-based access tiers with usage quotas

Features may be added, changed, or removed at any time. Beta features are provided "as is".

3. Accounts

• You are responsible for the accuracy of the information you provide and for all activity under your account.
• Keep your credentials confidential. Notify us immediately of any unauthorized use.
• One account per person. Creating multiple accounts to bypass quotas is prohibited.

4. Acceptable Use

You agree not to:

• Use the Service for illegal, infringing, or fraudulent listings
• Violate the terms of Vinted, Etsy, or any marketplace you operate on
• Reverse engineer, scrape, or abuse the API beyond the rate limits of your plan
• Resell, sublicense, or redistribute access to the Service
• Upload content you do not own or have the right to use

5. Subscriptions & Payments

• Paid tiers are billed via Stripe on a recurring basis until cancelled.
• Prices are shown in EUR and include applicable taxes where required.
• You may cancel at any time from your account page. Cancellation takes effect at the end of the current billing period.
• Credits are non-refundable and non-transferable except where required by law (e.g. EU 14-day withdrawal right for consumers, subject to exceptions for digital content you have already used).

6. Intellectual Property

The Service, including the extension code, website, logos, and documentation, is owned by SellMate AI and protected by copyright and other laws. We grant you a limited, revocable, non-exclusive license to use the Service for its intended purpose.

You retain ownership of the photos and content you upload. By using the Service you grant us a non-exclusive license to process that content solely to provide the Service to you (e.g. AI analysis, listing generation).

7. AI-Generated Content

AI-generated titles, descriptions, and suggestions are provided on a best-effort basis. You are solely responsible for reviewing and editing the output before publishing any listing. We do not guarantee accuracy, compliance, or fitness for a particular marketplace.

8. Third-Party Platforms

The Service interacts with third-party platforms (Vinted, Etsy, Google, Stripe, etc.). We are not affiliated with or endorsed by those platforms and are not responsible for their availability, content, or policies.

9. Suspension & Termination

We may suspend or terminate your access if you breach these Terms, abuse the Service, or create risk for us or other users. You may delete your account at any time from the account page.

10. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or marketplace account actions by third parties.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are not affected.
